AFPGEN upholds an individual’s data privacy rights and observes that all personal information, sensitive personal information, and privileged information collected and to be collected are processed or recorded, managed, organized, stored, updated, retrieved, consolidated, used, blocked, and erased according to the Data Privacy Act of 2012 (RA 10173), its Implementing Rules and Regulations (IRR), and various Circulars under the principles of transparency, legitimate purpose, and proportionality. By sharing your personal data and information with the AFPGEN in the process of applying for and availing bonds and insurance products, you hereby confirm with the following:

Data Privacy Consent and Waiver

As a customer of AFPGEN, you have certain rights under the Data Privacy Act, which include the following:

You certify that all personal data given to AFPGEN are true and correct to the best of your knowledge, freely and voluntarily given for purposes which are relevant and necessary in providing services to you.

As the Data Subject, you have the right to access, correct, or object to the processing of your Personal Data, or request for the deletion or suppression of your Personal Data subject to any limitation imposed by the Data Privacy Act of 2012 and its Implementing Rules and Regulations. In case your Personal Data is processed by electronic means and in a structured and commonly use format, you have the right to data portability. You may request to obtain a copy of your Personal Data in an electronic or structured format as may be prescribed by the National Privacy Commission. The lawful heirs and assigns of the Data Subject may invoke these rights at any time after the death or incapacity of exercising these rights by the Data Subject.

As AFPGEN policyholder and customer, you explicitly authorize the company, its directors, officers, consultants, employees, and duly authorized representatives to collect, store, update, use, process and to share, transfer or disclose the data to affiliates, contractors, partners, agents and representatives, intermediaries and third parties such as but not limited to adjusters, outsourced service providers, salvage buyers, banks, external auditors, and regulatory authorities consistent with the provisions of the Data Privacy Act.

You will hold AFPGEN free and harmless from any liability that may arise as a result of the authorization given.
